NOTICE OF DISAGREEMENT

- If your claim has been denied by the Regional Office or the rating is too low, or there are additional benefits due you, the first step in appealing to the Board of Veterans Appeals is to complete and file a Notice of Disagreement with the Regional Office.
- SIGN THE ATTACHED NOTICE OF DISAGREEMENT WHERE INDICATED AND INSERT THE DATE OF THE REGIONAL OFFICE DECISION LETTER WHERE INDICATED.
- Be sure to make a photocopy of the Notice of Disagreement for your records.
- Send the completed Notice of Disagreement to the Regional Office at the address shown in the Rating Decision. Be sure to send the Notice of Disagreement by certified mail, return receipt requested, at the Post Office. Save the return receipt in your records.
- Thirty days after you send in the Notice of Disagreement, call the Regional Office at 1-800-827-1000 and ask if your Notice of Disagreement is shown in their computer records as having been filed in the past month or so.
- If their computer records do not show your Notice of Disagreement, wait another thirty days and call them back. If they still say they don't have your Notice of Disagreement, it will be necessary to send them another copy of the Notice of Disagreement by certified mail, return receipt requested.
- After you file your Notice of Disagreement, the Regional Office will send you a Statement of the Case. You must have this Statement of the Case before you can finalize your appeal. If you haven't received the Statement of the Case in six months, call the Regional Office at 1-800-827-1000 and ask them what happened to it.
- Once you receive the Statement of the Case your next step is to file an appeal to the Board of Veterans Appeals (Form 9). See "Tracking Your VA Claim" form.
